Kolbera Terms of Service

1. Acceptance of Terms

By using Kolbera’s platform or purchasing live calls (“Calls”), you (“Sales Professional,” “User,” or “You”) agree to these Terms of Service (“Agreement”). If you do not agree, do not use the service. Kolbera may update these Terms at any time. Continued use after changes means you accept them.

2. Services and Use

Live Call Delivery

Kolbera connects you directly with real consumers by phone. These customers have requested insurance services and are transferred to the phone number you provide.

Use of Consumer Information

If any customer data is provided with a call, it may only be used to assist with that specific conversation. You agree to follow all laws and regulations, including the Telephone Consumer Protection Act (TCPA) and relevant privacy laws.

Prohibited Use

You may not resell, reuse, or share any consumer information you receive through Kolbera. You may not contact unconverted leads, and you may not use the information for any purpose outside of the intended sales interaction.

3. Legal Compliance

You agree to comply with all applicable federal, state, and local laws. This includes laws related to telemarketing, privacy, and consumer consent. You may not use robocalls, autodialers, or prerecorded messages when contacting leads from Kolbera.

4. User Responsibilities

You agree not to falsify your identity, misrepresent your business, or attempt to access or interfere with Kolbera’s systems. You also agree that all information you provide to Kolbera is accurate and up to date. You consent to Kolbera monitoring or recording calls for quality assurance, compliance, and support purposes.

5. Payments

All live calls must be paid for in advance. No calls will be delivered without full prepayment. By submitting payment information, you authorize Kolbera to charge your card or preferred method for the services selected.

6. Confidentiality

All information you receive from Kolbera, including consumer details and Kolbera’s internal processes, must be treated as confidential. If required by law to disclose confidential information, you agree to notify Kolbera beforehand when legally possible.

7. Call Delivery

A call is considered delivered once it connects to the phone number you provided. If no one answers within two rings, our system automatically moves the call to the next available agent. You are only charged if we ring you first, no answer, then it continues to skips back around to you for a second time. At that point, you lose one of your remaining calls. Kolbera has no issues with call volume and delivery times are set by you through the agent portal.

8. Termination and Cancellation

You may cancel your service at any time by written notice. Any unused call credits are non-refundable but can be used toward future purchases. Teams call purchases can request a full refund on unused calls

9. Billing Disputes

You must submit any billing disputes within three calendar days of the charge. After that, all charges are considered final. All communication related to billing disputes must remain private. Publicly disclosing billing disputes may result in termination of service.

10. Warranty Disclaimer

All services are provided “as is.” Kolbera does not guarantee call quality, lead performance, close rates, or sales results.

11. Limitation of Liability

Kolbera’s total liability for any claim is limited to the amount you paid during the calendar quarter in which the issue occurred. Kolbera is not liable for lost profits, lost opportunities, or any indirect damages.

12. Indemnification

You agree to hold Kolbera harmless against any claims, losses, or legal expenses that result from your use of our services or violation of these Terms.

13. Arbitration and Disputes

All disputes must be resolved through binding arbitration under the American Arbitration Association. Arbitration will take place in either Delaware or Nevada, at Kolbera’s discretion. You agree to waive any right to a jury trial or class-action participation.

14. Governing Law

This Agreement is governed by the laws of the State of Delaware and the State of Nevada.

15. Entire Agreement

These Terms represent the complete agreement between you and Kolbera and override any previous agreements or communications.
